By accessing or using LeadAtlas (“Service”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree, you may not use the Service.

LeadAtlas is a product of Fervoid Ventures FZ-LLC (“LeadAtlas”, “we”, “our”, or “us”).

2. Description of Service

LeadAtlas is a software platform that enables users to discover, analyze, and access business-related contact data, including information sourced from publicly available data and third-party providers.

We do not guarantee the accuracy, completeness, or reliability of any data provided.

3. Eligibility

You must be at least 18 years old to use the Service.

By using LeadAtlas, you represent that:

• You are legally capable of entering into a binding agreement

• You will comply with all applicable laws and regulations

4. Accounts

You are responsible for:

• Maintaining the confidentiality of your account

• All activities under your account

You may not:

• Share your account with others

• Transfer or resell your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription, Billing, and Refunds

A. Subscription Plans

LeadAtlas offers paid subscription plans and a limited free plan.

B. Billing

• Subscriptions are billed in advance on a recurring basis.

• You authorize us to charge your payment method for all applicable fees.

C. Refunds

• Refunds are provided at our sole discretion.

• Refunds may be issued depending on the circumstances, including but not limited to billing errors or service issues.

6. Credits System

LeadAtlas operates on a credit-based system.

• Credits are used to access features and data within the platform

• Credits are allocated based on your subscription plan

Rollover Policy:

• Credits roll over only for Navigator and Voyager plans

• Credits for other plans do not roll over and may reset each billing cycle

Credits have no monetary value and are non-transferable.

7. Acceptable Use

You agree NOT to:

• Use the Service for unlawful purposes

• Violate any data protection or privacy laws

• Send unsolicited or abusive communications (spam)

• Harass, harm, or exploit individuals

• Scrape, copy, or resell LeadAtlas data

• Use the Service to build a competing product

• Circumvent security or access controls

You are solely responsible for how you use the data obtained through LeadAtlas.

8. Business Contact Data Disclaimer

LeadAtlas provides access to business-related contact data derived from public sources and third-party providers.

We do not:

• Guarantee accuracy or completeness

• Verify all data in real-time

You are responsible for ensuring your use of such data complies with applicable laws, including privacy and marketing regulations.

9. Third-Party Services

LeadAtlas relies on third-party providers (e.g., data providers, payment processors, infrastructure services).

We are not responsible for:

• Third-party services

• Their accuracy, availability, or performance

10. Intellectual Property

All rights, title, and interest in the Service remain the property of LeadAtlas.

You may not:

• Copy, modify, or distribute our platform

• Reverse engineer or replicate our system

11. Termination

We may suspend or terminate your account at any time if you:

• Violate these Terms

• Misuse the platform

• Engage in unlawful activity

You may cancel your subscription at any time.

12. Limitation of Liability

To the maximum extent permitted by law:

LeadAtlas shall not be liable for:

• Any indirect, incidental, or consequential damages

• Loss of profits, data, or business opportunities

Our total liability shall not exceed the amount paid by you in the last 3 months.

13. Indemnification

You agree to indemnify and hold harmless LeadAtlas and Fervoid Ventures FZ-LLC from any claims, damages, or liabilities arising from:

• Your use of the Service

• Your violation of these Terms

• Your misuse of data obtained through the platform

14. Data Compliance Responsibility

You acknowledge that:

• You are responsible for complying with all applicable laws

• This includes GDPR, CCPA, CAN-SPAM, and other data protection laws

LeadAtlas is not responsible for how you use the data provided.

15. Changes to Terms

We may update these Terms from time to time.

We will notify users of significant changes via:

• Email

• Platform notifications

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any disputes shall be subject to the exclusive jurisdiction of UAE courts.

17. Miscellaneous

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LeadAtlas regarding the use of the Service and supersede any prior agreements or understandings.

Waiver

Our failure to enforce any provision of these Terms shall not be considered a waiver of our right to enforce such provision at any later time.

No Assignment

• You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent.

• We may assign or transfer our rights and obligations under these Terms without restriction.
